Registration of authorised representative
To avoid free-riders further to growing online trade and other distance selling the concept of Authorised Representative (AR) was introduced with the WEEE Directive recast in 2012.
The provision was implemented as a requirement for all electronics manufacturers in EU countries selling directly to end-users in Denmark.
E-trade for end-users
If your business in the EU is not established in Denmark but deals distance selling, for instance internet trade, directly to end-users in Denmark you must assume your producer responsibility by designating an authorised representative (AR) in Denmark. If your business has an authorised representative, you can have this representative assume the interests of your business in relation to selection of a collective scheme or choice of individual solutions. The AR or his/her collective scheme undertakes the annual reporting to the DPA producer register.
An AR is a legal entity established in Denmark, as an active Danish company in the central business register (CVR) with a Danish CVR number, and designated by one or several foreign businesses in the EU to assume their producer responsibility in Denmark
EU businesses without an Danish AR are deleted
Businesses without a Danish CVR number selling directly to end-users can only establish a registration in the Danish producer register provided they submit simultaneously a request to a Danish AR. It is also a precondition that the Danish AR accepts this request, since the registration will otherwise not be approved, but deleted from the register.
How to appoint a Danish AR
In practice, to appoint the authorised representative the European business, through his/her just established registration in the producer register, the system sends a request through a mail module to a representative with a Danish CVR number. When the AR has digitally confirmed the designation, the official registration and access is made in the producer register.
Difference between collective scheme and authorised representative
The authorised representative has the legal responsibility towards the authority on behalf of the producer, while a collective scheme is a commercial company offering to producers to carry out various practical tasks, including collection and recovery – with the purpose of benefiting from economies of scale.
Collective schemes can also assume the registration and reporting to the producer register for the producer.
