Is your business subject to producer responsibility?

The products you deal in decide whether you are subject to producer responsibility. Therefore, always first check whether your products are in scope and then whether your business is the one carrying the responsibility. Please note that the result of the test is not a legal decision; it should only be seen as a guidance.

Where is the business established?

Your business is established abroad if you do not have a Danish CVR number.

Does your company manufacture or import products for sale in Denmark?

This means you are the first level of the distribution chain in Denmark.

Has your business manufactured the products / have you had the products manufactured by a subcontractor according to your specifications and under your brand and/or name?

A subcontractor means another business that manufactures products for your business according to your directions and specifications and, in some cases, label the product with your brand and/or name. Thereby, a subcontractor only makes its production capacity available, but your business is the one playing the role of the producer who draws up and/or makes decisions about the detailed specification of the products.

Is your business dealing in distance selling to end-users in Denmark?

Distance selling means that there are no third parties involved and you sell directly to the end-user. You must register directly in the producer register. This may be, for instance, the sale of electrical and electronic equipment by means of distance communication directly to private households or to users other than private households in Denmark, and that you are established in another EU Member State or in a third country.
