Cease, changes, mergers

All businesses undergo different changes in their legal form or product range. See what to do in case of changes relating to your registration under the producer responsibility system.

Do-it-yourself or contact DPA

If there are changes to your legal form that affect your producer responsibility you can make most of the changes yourselves once logged in. Certain issues, however, request an interaction of DPA.

Changes in product categories, compliance scheme, or AR?

You can select and de-select categories yourselves through a login to your registration in the producer register. This also applies to establishment or change of relation to a collective scheme or an authorised representative (AR).

If you cease business or discontinue the sale of in-scope products you must be deleted from the DPA producer register. You must also contact us if you merge with another business.

DPA update through CVR

The producer register is linked to the Danish Business Authority’s Central Business Register (CVR). From here your business’s master data are updated (apart from contact persons and personal email addresses), and operating status: Active,  Normal, Bankruptcy, or Cease. So, it is important that your information in CVR is updated, since this information appears when we update from the CVR register.

Is the business bankrupt or ceased?

If the business no longer appears in CVR this will be reflected automatically in the producer register, and your registration will be discontinued.

If you are a member of a collective scheme this scheme will generally undertake any contact to DPA on your behalf – however, the request for discontinuation in the producer register will always require written documentation or that you contact us as the business subject to producer responsibility.

If your business has ceased or you no longer place in-scope products on the market you must therefore submit a written note stating your request to be deleted to DPA on info@producentansvar.dk. It is not possible to delete registration retrospectively.

If you wish to be deleted from the register it is no longer legal for your business to place electrical and electronic products, batteries or accumulators, and vehicles on the Danish market. Furthermore, it is illegal for distributors and dealers to buy your products.

Portable batteries?

If you cease to place portable batteries on the market this must also be communicated to the Danish Business Authority, since your tax liability to SKAT will cease.

Change in compliance scheme affiliation

You can change the organisation of your producer responsibility from one collective scheme to another or from individual complier to collective compliance or vice versa.

In cases where your business leaves a scheme and/or enters a new one, you must log onto your registration with DPA and change the registration per category under the menu item Collective schemes, so we can see the current type of affiliation.

Note that it is not possible to change type of affiliation retrospectively and not in the reporting period from 1 January to 31 March.

Household electronics and portable batteries

Also note that if you place equipment on the market for use in households as well as portable batteries that are covered by the Allocation Scheme any changes of compliance scheme will have certain implications depending on the time of year of the change. Therefore, it is important that you check the implications of a change before making this change in your registration.

Change of authorised representative

Businesses in other EU countries not having a Danish CVR number must have an authorised representative in Denmark who assumes their producer responsibility. Both the producer and the Danish authorised representative may change this link whenever they please – also in the reporting period. Connection and de-connection of a representative is done through the access of the producer or the representative in the producer register.

Mergers

If your business ceases due to a merger, different rules apply to new registration and updating in the DPA producer register. The rules depend on the CVR number that the business chooses to use when the merging business registers with the Danish Business Authority.

Change of CVR number

The business must inform DPA in writing when changes in the use of a CVR number occur. If the business chooses to register under a completely new CVR number DPA can assist to ensure that historic data are maintained in a new registration, if needed.
