Determination on producer responsibility
If you are unsure whether producer responsibility applies to you, you can request a determination in which we establish whether you or your products are subject to producer responsibility.
Start by taking the test
You can take a short test to get an indication of whether your company is subject to producer responsibility. The test asks a number of questions about your products and your role in the supply chain. The result gives you an overview, but it is not a binding determination. If you want a final and legally binding assessment, you must request a determination.
What does a determination entail?
A determination establishes whether your company and products are subject to the extended producer responsibility for Electronics, Batteries, Packaging, Single-use Plastics, Fishing Gear, or Vehicles.
A determination is binding and will always entail:
- An assessment of whether your products are subject to producer responsibility.
- An assessment of whether your company holds the producer responsibility for the relevant products.
If we conclude that you are subject to producer responsibility, you must register in the Danish producer register.
How to request a determination
To process your case, we need information about your company.
Complete the application form relevant to you and send it to jura@producentansvar.dk or via Digital Post.
If the application contains sensitive information, we recommend that you send it via Digital Post.
Who can request a determination, and how do you appeal?
Only the producer itself or the Danish Environmental Protection Agency can ask DPA to issue a specific determination on whether a company is subject to producer responsibility. If you disagree with our determination, you may appeal to the Danish Environmental Protection Agency. The appeal must be submitted in writing within four weeks. Be advised that in the event of any translation errors or ambiguous wording in the English translations, the Danish-language versions remain the legally binding versions.
