Statutory basis for vehicles and end-of-life vehicles

The purpose of the producer responsibility legislation for vehicles is to reduce the adverse environmental impacts from scrap cars and to ensure a healthy market for environmental treatment of end-of-life vehicles. The legislation takes offset in EU Directive on End-of-Life Vehicles (ELV). In Denmark, the Directive is implemented with the Danish Environmental Protection Act and the Statutory Order on End-of-Life Vehicles. The scrapping system and payment of scrapping premium, as well as the incentive structure are set out in the Statutory Orders.

The ELV Directive defines the general responsibilities and regulation areas for all players engaged in the sale and scrapping, as well as environmental treatment and recycling of vehicles (passenger cars and small trucks).

This general order is a consolidation of previous statutory orders on producer responsibility for vehicles, environmental contributions, and the scrapping system. The latter is a national incentive system for citizens etc. in connection with the scrapping of end-of-life vehicles.

From EU to DK

The Directive on end-of-life vehicles (the ELV Directive) establishes common EU rules on the management of end-of-life vehicles. The rules take offset in environmental considerations and aim to limit inappropriate disposal of ELVs.

Producer responsibility has authority in the Danish Environmental Protection Act as reflected in the so-called Statutory Order on End-of-Life Vehicles.

Legislation applies to all producers and importers placing passenger cars (M1) and small trucks (N1) on the Danish market. In addition, car breakers, dealers, recycling industries, and citizens etc. are regulated in part of this regulation.
